ابراز نگرانی سازمان عفو بين الملل از شکنجه ۹ فعال حقوق فرهنگی آذربايجان
سازمان عفو بين الملل، روز دوشنبه ۲۲ ماه سپتامبر، نسبت به «شکنجه» ۹ فعال حقوق مدنی آذربايجان، ابراز نگرانی کرد. در اعلاميه سازمان عفو بين الملل گفته شده که ۹ فعال فوق، روز ۱۰ سپتامبر ۲۰۰۸ توسط نیروهای امنیتی دستگیر شده اند و هم اکنون در بند ۲۰۹ زندان اوين، که زير نظارت سازمان اطلاعات جمهوری اسلامی قرار دارد، در بازداشت به سر می برند. آنها در معرض شکنجه و رفتار خشونت آمیز قرار دارند.

ایران - فعالان حقوق فرهنگی آذربایجان: علیرضا صرافی (مرد) سن 53 مهندس عمران, روزنامه نگار و فعال فرهنگی ؛ اکبر آزاد (مرد) نویسنده؛ حسن راشدی, مهندس، مدرس زبان ترکی؛ سعید محمدی موغانلی، شاعر و روزنامه نگار؛ حسن رحیمی بیات, مهندس عمران، فعال حقوق بشر؛ حسین حیدری، دانشجوی ارشد جامعهشناسی؛ عباس نعیمی, فعال فرهنگی و عضو NGO اورین؛ مهدی نعیمی, شاعر و استاد زبان ترکی در دانشگاهها؛ صیاد محمدیان, فعال در زبان ترکی. ۹ فعال آذربایجانی که در بالا نامشان قید شده است ازتاریخ دستگیریشان در ۱۰ سپتامبر در زندان انفرادی نگهداری میشوند.آنها در زندان انفرادی سرویس اطلاعات در بند ۲۰۹ زندان اوین تهران محبوس میباشند و در معرض خطر شکنجه و رفتار نامناسب قرار دارند. چنین به نظر میآید مسئولین خواستهاند تا هرفعالیتی که احتمالا منجر به اعتراض به روز شروع مدارس (۱ مهر مصادف با ۲۳ سپتامبر) شود جلوگیری کنند. عفو بینالملل معتقد است که احتمالا آنها به خاطر عقیدهشان زندانی شدهاند وزندانی شدن آنها به جهت بیان خواستهی صلحآمیرشان که از حق آزاد ی و بیان خواستههای جمیعشان هست ناشی گردیده است. در غروب ۱۰ سپتامبر نیروهای لباس شخصی که باور میشود نیروهای اطلاعات باشند حداقل ۱۸ آذربایجانی که برای مراسم افطار دور هم جمع شده بودند را بازداشت کردند. آنها در خانه آقای صیاد محمدیان فعال آذربایجانی که از بازداشتشدگان است دستگیر شدند بدون اینکه حکم حبسی در ضمن جلب صادر شده باشد. بازداشتشدگان از فعالان برجسته جامعه فعالان آذربایجانی ایران هستند که شامل نویسندگان، روزنامهنگاران و مدافعان حقوق بشر میباشند. در بین ۱۸ نفر بازداشتشدهگان زن و بچه هم بودند که بعداً آزاد شدند. آقایان و خانمها بعد از بازپرسی به قید کفالت آزاد شدهاند که شامل رقیه علیزاده، همسرعباس لسانی (رجوع شود به: UA 163/06, MDE 13/063/2006, 08 June 2006, and follow-ups) زندانی عقیده است و سه فرزند آنهاست که مدت اندکی نگه داشته شدهاند. خانواده این نه نفر هیچگونه اطلاعاتی راجع به آنها ندارند. در ۱۵ سپتامبر کارمند دادگاه تهران به وجیهه فکور همسر علیرضا صرافی (یکی از زندانیان) گفته است که ۹ نفر بازداشتی در بند ۲۰۹ اوین به صورت انفرادی زندانی میباشند و بازپرسی از آنها چند هفته به طول خواهد کشید. وجیهه فکور (صرافی) با رادیو فردا که یک شبکه خارج از ایران است درباره دستگیرشدگان گفتگویی انجام داده است. مسئولین به زور وارد خانه شدند لپ تاب، وسایل شخصی، دستنوشتههای علیرضا صرافی و تمامی کتابهای ترکی آذربایجانی خانه را، سیدیها و تمامی کارتهای شناسایی خانوداگی شامل پاسپورتها را با خود بردند. ۱۰ نفر آنها برگهای به این مضمون همراه داشت که "برای مقابله با افراد پان تورکیست و قومگرا اجازه ورود با زور برای آنها صادر شده است و میتوانند موانع فیزیکی این کار از پیش بردارند " اما برای عفو بینالملل این مجوزها قانونی نیست. در سالهای گذشته روز اول مهر (روز بازگشایی مدارس) توسط فعالان آذربایجانی تحریم میشد. تا نشان دهنده تضییع حقوق کودکان آذربایجانی جهت آموزش به زبان مادری خویش باشند (نگاه کنید به وضعیت عمومی در: http://www.amnesty.org/en/library/asset/MDE13/108/2006/en/dom-MDE131082006en.html) سال تحصیلی در یک مهر در ایران شروع میشود. چنین برداشت میشود که مسئولین امر این فعالین را جهت جلوگیری از طرح بایکوت مدارس در یک مهر بازداشت کرده باشند.
اطلاعات پیشزمینه:
آذربایجانیها ؛ در ایران بزگترین اقلیت قومی باشند آنها عمدتا شیعه بوده و در مناطق شمال و شمالغرب ایران ساکن هستند و دست کم 25 الی 30 در صد از جمعیت ایران را شامل می شوند. اگر چه آنان بطور کلی در جامعه ایران بخوبی جذب شده اند، اما در سالهای اخیر بطور فزاینده ای حقوق فرهنگی و زبانی مانند حق تحصیل بزبان ترکی آذربایجانی، که معتقدند در قانون اساسی ایران آمده است، و همچنین حق تجلیل از میراث فرهنگی و تاریخی خود را مطالبه کرده اند که اغلب این مطالبات توسط مقامات ایرانی سرکوب شده است.
اقدامات پیشنهادی:
- اصرار به مقامات برای کسب اطمینان از اینکه فعالان حقوق مدنی آذربایجانی : علیرضا صرافی، اکبر آزاد، حسن راشدی، سعید محمدی موغانلی، حسن رحیمی بیات، حسین حیدری، عباس نعیمی، مهدی نعیمی و صیاد محمدیان با شکنجه و بد رفتاری مواجه نمی شوند. - اصرار به مقامات برای دسترسی فوری و مرتب افراد فوق به خانواده خود و وکیل مورد نظر خودشان و هر نوع مداوای پزشکی که لازم داشته باشند. - درخواست از حکومت جمهوری اسلامی برای رها کردن زندانیان ۱۰ سپتامبر مگر اینکه جرم جزایی داشته باشند و خاتمه دادن هر چه سریعتر به بازداشت موقت آنها؛ - دراینجا یادآوری میشود که اگر آنها تنها به علت بیان حقوق آزادی خود و تجمع زندانی شده باشد پس آنها زندانی عقیده هستند و باید فورا و بدون قید و شرط آزاد شوند.

In the late afternoon of 10 September, plain clothed officers, believed to be Ministry of Intelligence officials, arrested at least 18 Iranian Azerbaijanis who were gathering to break the Ramadan fast. The gathering was held in the house of Sayyad Mohammadian, an Azerbaijani activist, who is one of those detained. No warrant was produced at the time of arrests. Those detained are prominent activists in the Iranian Azerbaijani community. They included writers, journalists and human rights defenders. Among the 18 arrested were women and children, who were later released. The women and men who were released were freed on bail after being interrogated. They included Ruqeyye Elizade Lisani, the wife of prisoner of conscience Abbas Lisani (see UA 163/06, MDE 13/063/2006, 08 June 2006, and follow-ups). The couple's three children were also held briefly. The families of the nine who are still being held have been unable to obtain any information about the charges brought against them. On 15 September, a Tehran court official told Vejihe Fukur Serrafi, the wife of one of the detainees, Alireza Serrafi, that the nine individuals were held in solitary confinement in Section 209 of Evin Prison and that their interrogation would take some weeks. Vejihe Fukur Serrafi later appeared on the Persian-language Radio Farda, which broadcasts from outside Iran, and spoke about the arrests. On 18 September, the authorities forcibly entered her home, searched it and confiscated personal property, including laptops, handwritten notes belonging to Alireza Sarrafi, all the books in the house that were in the Azerbaijani Turkish language, CDs, and all family personal identification documents, including passports. The officers produced a handwritten note stating “for confrontation with pan-Turkist and pro-identity individuals permission has been granted to make forced entries, arrest and eliminate physical obstacles” but it is not clear to Amnesty International whether this constitutes a warrant. In previous years, Iranian Azerbaijani activists had called for a boycott of the first day of the school year, and for demonstrations to be held calling for Iranian Azerbaijani children to be allowed the opportunity to be educated in their own language (see AI Public Statement at http://www.amnesty.org/en/library/asset/MDE13/108/2006/en/dom-MDE131082006en.html ).This year the start of the new academic year in Iran falls on 1 Mehr (23 September), and it appears that the current arrests are part of the authorities' efforts to pre-empt protests or boycotts. BACKGROUND INFORMATIONIranian Azerbaijanis, who are mainly Shi'a Muslims, are recognized to be the largest minority in Iran and are generally believed to constitute between 25-30 percent of the total population. They are located mainly in the north and north-west of Iran. Although generally well-integrated into society, in recent years, they have increasingly called for greater cultural and linguistic rights, such as the right to education through the medium of the Azerbaijani Turkic language, which they believe is provided for under the Constitution, and to celebrate Azerbaijani culture and history at cultural events. RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, French, or your own language:- urging the authorities to ensure that Azerbaijani rights activists Alireza Serrafi, Akbar Azad, Hassan Rashidi, Sa'id Mohammadi Mughanli, Hassan Rahimi Bayat, Hossein Haydari, Abbas Na'imi, Mehdi Na'imi,and Sayyad Mohammadian are not facing torture or ill treatment; - urging the authorities to allow the nine individuals immediate and regular access to their family and a lawyer of their choice, and to any medical treatment they may require; - calling on the authorities to release all those detained on 10 September unless they are to be charged with a recognizably criminal offence and given a prompt and fair trial; - noting that if they are held solely on account of their expression of their right to freedom of expression and assembly, then they are prisoners of conscience, and should be released immediately and unconditionally.
